You must be at least 18 years of age to use Heart of Gold. By registering, you confirm that you meet this requirement. We reserve the right to terminate accounts where this requirement is found to have been misrepresented.
Heart of Gold is currently available to residents of and visitors to the State of Texas.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

The following are strictly prohibited and will result in immediate, permanent termination of your account without refund:
Heart of Gold does not facilitate, enable, or process any payment between members. There are no virtual gifts, no tips, no paid messages, no pay-to-unlock content, and no in-app purchases. Members must not solicit or accept money, gifts, or other consideration from one another in connection with this service. Off-platform commerce between members is outside the scope of, and not endorsed by, Heart of Gold.
You retain ownership of any content you submit to Heart of Gold. By uploading photos or other content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and process your content solely for the purpose of operating and improving the service.
You confirm that any photos you upload are of yourself, that you are the owner or have the right to use them, and that they comply with our Community Policy. All profile photos are reviewed before publication, and your live selfie is compared against your photos using an automated face-verification system.
Our Privacy Policy describes how we collect, use, and protect your personal information. By using Heart of Gold, you agree to the practices described in that policy.
Heart of Gold operates on a subscription model. After your free trial period ends, continued access requires a paid subscription. Subscription fees are billed monthly directly by Heart of Gold to the cardholder.
All payments are processed by Stripe, our exclusive payment processor. By subscribing, you also agree to Stripe's terms. We do not store full payment card numbers on our systems.
Founding member rates, where offered, are locked for the duration of your continuous subscription. If your subscription lapses, the founding rate may not be available when you re-subscribe.
Refunds: Subscription fees are non-refundable except where required by law. If you believe a charge is in error, please email hello@heartofgoldaustin.com within 30 days and we will review in good faith. To avoid further charges, cancel your subscription before the next renewal date through your profile settings.
You may delete your account at any time through your profile settings. We may terminate or suspend your account at any time for violations of these Terms or our Community Policy, with or without notice and without refund.
Upon account deletion, your profile and personal data will be removed from our systems in accordance with our Privacy Policy.
Heart of Gold is provided "as is" without warranties of any kind. We do not guarantee that you will find a match, that other users' profiles are accurate, or that the service will be uninterrupted or error-free. We are not responsible for the conduct of other users, whether online or offline. Always exercise appropriate caution when meeting someone in person.
To the fullest extent permitted by law, Heart of Gold and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
We may update these Terms from time to time. We will notify you of material changes by email or through the app. Continued use of Heart of Gold after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Travis County, Texas.
